It means Simpson, 31, will be risk-assessed by a parole team rather than automatically let out.
She and the dad of Tony, now ten, got ten years in 2018.
She was let out on licence, but went back for breaching the conditions by having a fling with a sex offender.
She is due up for parole on May 19, with her hearing being held in private, although under a new policy Tony’s adoptive family are allowed to attend.
Tony’s adoptive mum, Paula Hudgell, 57, from West Malling, Kent, said: “We are relieved that Jody will be facing a full parole hearing rather than being released with no risk assessment.
“She was recalled to prison for good reason, and it’s only right considering what she did that checks and balances are put in place to stop her reoffending.
“As soon as she got out of prison last time, she started a relationship with a sex offender, she clearly can’t be trusted and needs proper oversight from a parole team if she is released in May.
“We are grateful that ministers have recognised this risk, and have acted on it.
“The only thing that would reassure us more is if she was added to a child cruelty register – similar to a sex offenders register – something we have been campaigning for for years.”
