The US Oscar-winning screenwriter denies he assaulted BBC Three host Teddy Edwardes, 33.

A judge heard cops lost her interview and video footage was not saved.

Black appeared before Westminster JPs from his LA home via videolink, where it was 2am.

District judge Louisa Ciecióra agreed there had “been failures”.

But she said a trial should still go ahead on November 8.

Black, who has two kids with Daley, 29, is accused of twisting Edwardes wrist, spilling drink over her in Soho, central London, last year.

Earlier this year a court heard Edwardes had been cautioned for punching Black during the row.
